REPEAL ALL 3 B2B TAXES IN 2014 SESSION

Urge the Governor and legislature to repeal all 3 B2B taxes during the first week of the 2014 Legislative Session

The 2013 Legislature approved many changes in tax laws that will have a big impact on Minnesota businesses.  Many of these changes took effect July 1, and some are even retroactive to January 1, 2013. These new taxes include individual income tax, withholding taxes, corporate taxes, sales taxes, estate and gift taxes, and cigarettes.

Among the new costs facing Minnesota businesses is the expanded sales tax on business-to-business (B2B) services. Minnesota companies will now pay the 6.875% state sales tax, plus any local sales tax, on three significant categories of business-to-business services. The United for Jobs Coalition defeated Governor Dayton’s broad-based sales tax on B2B transactions, but the final budget enacted the sales tax in three categories:

• Labor service charges for repair and maintenance of business equipment and machines, effective July 1, 2013. Full Details

• Purchases of telecommunications equipment by telecommunications providers, effective July 1, 2013. Full Details

• Storage and warehousing services of business-related goods, effective April 1, 2014. Full Details

The B2B taxes do not apply if a service is done by an employee or an affiliated company. The tax does apply, however, if your business is paying another business or individual for the service. These taxes will place the affected businesses – especially small and midsized companies that do not have in-house expertise – at an extreme disadvantage with your peers in other states and nations.
